According to a report published in the Wall
Street Journal, about one person in 250,000 to 300,000 taking
Serzone will suffer liver failure.
A number of U.S. psychiatrists became concerned about the
Serzone liver failure problem following the Canadian government
issued warning on June 20, 2001.
A company spokeswoman at Bristol-Myers was asked why warnings
were sent to Canada but not to American physicians warning
of the possible fatal liver damage Serzone can cause. The
spokeswoman, Tracy Fury, responded that, "We
didn't' think it was necessary in the U.S. because what happened
in Canada was specific to Canada."

| There are various laws intended to protect consumers
at the state and federal level for products, including pharmaceutical
drugs that do not perform the way they have been promised or warranted

has been ordered by the FDA to strengthen their antidepressant drug's
label with a Black Box warning. A Black
Box warning is the strongest type of warning that the FDA can
require in a drug's labeling. This action came after reports of serious
liver failure instances that led to transplant and/or death in Serzone
patients.
The Serzone label changes were first made December 2001 and again
in January 2002. Although the FDA ordered that Serzone manufacturer
strengthen their label on two separate occasions, this FDA practice
has been highly criticized for its ineffectiveness. Doctors have
even admitted never looking at labels that have been changed after
the FDA has ordered strengthened label indications. Critics wonder
what type of impact a leaflet warning of possible death or serious
injury can have in fine print.

Over 109 cases of serious Serzone
liver damage have been reported with at least 23 cases of liver
failure that resulted in 16 liver transplants and/or died. In 1999,
about 5,000 people died waiting for organs, and about 1,200 of those
were waiting for a liver. More than 68,000 people are now waiting
for organs, with 15,000 of them waiting for a liver. First approved
introduced to the market in 1994, Serzone has been used by approximately
8.3 million people worldwide, 7 million in the U.S. alone. Bristol-Myers
has generated about $400 million in annual sales with Serzone alone.
